Terms and Conditions of Sale – Pharmacylabels.direct 

Please read these Terms and Conditions of Sale (“Agreement”) carefully before making a purchase from Pharmacylabels.direct (“Company”). This Agreement sets forth the terms and conditions governing the sale of our bespoke labels. By placing an order, you agree to be bound by this Agreement.

  1. Product Description and Specifications: a. The Company offers bespoke labels that are custom-designed and manufactured to meet the specific requirements of the customer (“Product”). b. Product descriptions provided by the Company are for informational purposes only and may not be entirely accurate. We reserve the right to modify or update the specifications of the Product without prior notice. c. The customer is responsible for providing accurate and detailed specifications, artwork, and other necessary information for the design and production of the bespoke labels.
  2. Order Placement and Acceptance: a. All orders placed through our website or other approved channels are considered offers to purchase bespoke labels. b. The Company reserves the right to accept or reject any order in its sole discretion. c. Upon receipt of an order, we will send an order confirmation via email or other appropriate means. The order confirmation constitutes acceptance of the order.
  3. Pricing and Payment: a. Product prices are determined based on the specifications provided by the customer and will be shown on screen when a quantity is entered. b. All prices are exclusive of taxes & duties unless otherwise stated. d. Payment for bespoke labels must be made in full at the time of placing the order. e. We accept payment via credit/debit card or PayPal. Payment details will be collected during the checkout process.
  4. Design and Approval: a. Pharmacylabels.direct is a design tool where the customers designs their own labels. b. The customer is responsible for carefully reviewing and approving the proofs. c. Once the customer approves the design, the Company will not be responsible for any errors, omissions, or discrepancies in the final product resulting from the approved design.
  5. Production and Delivery: a. The Company will make reasonable efforts to complete the production and delivery of the bespoke labels within the agreed timeframe. b. Any estimated delivery dates provided by the Company are for reference only and are not guaranteed. c. Risk of loss and title for the bespoke labels pass to the customer upon delivery. The customer is responsible for inspecting the labels upon receipt and notifying the Company of any damages or discrepancies within 48 hours.
  6. Returns and Refunds: a. Due to the customised nature of bespoke labels, returns and refunds are generally not accepted unless the Product is defective or does not meet the agreed-upon specifications. b. If the customer believes the Product is defective or does not meet the specifications, they must notify the Company within 7 days of receipt and provide evidence of the issue. c. The Company reserves the right to evaluate and determine the validity of any claims for defective or non-compliant Products. If approved, the Company may offer a replacement or refund at its discretion.
  7. Intellectual Property: a. All intellectual property rights related to the bespoke labels, including but not limited to design concepts, artwork, and logos, remain the property of the Company unless otherwise agreed upon in writing. b. The customer warrants that they have the necessary rights and permissions to use any artwork, logos, or other intellectual property provided to the Company for the creation of the bespoke labels.
  8. Limitation of Liability: a. The Company’s liability for any claim arising out of or in connection with the sale of the bespoke labels shall be limited to the total amount paid by the customer for the specific Product giving rise to the claim. b. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of the bespoke labels.
  9. Governing Law and Jurisdiction: a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is located. b. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
  10. Entire Agreement: This Agreement constitutes the entire understanding between the customer and Pharmacylabels.direct and supersedes all prior agreements, understandings, or representations, whether oral or written, with respect to the sale of the bespoke labels.
